This is a draft and hasn’t yet been reviewed by a solicitor. If anything here is unclear or looks wrong, tell us.
1. About these terms
These terms apply when you use this website, ask for a demo call or book a consultation. In them, “we” and “us” means whitsun. whitsun is a company being registered in England and Wales.
By using the site you accept these terms. If you don't agree, please don't use it. They don't cover whitsun as a paid service: customers sign a separate written agreement, which governs if it conflicts with anything here.
2. The demo call
The demo call is free. It is an automated call from our AI assistant to show what whitsun sounds like.
You may only ask for a call to a mobile number that is yours, or that you are authorised to use. Don't use the demo to call anyone else, and don't try to misuse it (for example by requesting calls automatically, or trying to make the assistant produce harmful or unlawful content).
On the call you may be put through to a pretend business. That business is fictional: nothing said on the call is booked, confirmed or advice of any kind, clinical, legal, financial or otherwise.
The assistant can make mistakes. It is a demonstration, and we don't guarantee it will be available, or work without errors or interruption. We limit how often any number or connection can ask for a call and may pause the demo at any time.
How we handle your number, the recording and the transcript is explained in the privacy policy.
3. The free consultation
A video call with the whitsun team about how your calls come in and whether whitsun would suit your business. It is free and there is no obligation to buy anything. We may need to rearrange it; we'll tell you as early as we can.
4. Prices and information on the site
Prices on the site show roughly what whitsun costs. They aren't an offer: your plan, its price and its terms are agreed in writing before you pay anything, and we'll tell you whether VAT applies.
We work to keep the site accurate and current, but it's general information, not advice for your business. Product pictures are labelled as examples and may differ from the product you use.
5. Using the site
Please don't:
- use the site or the demo in a way that breaks the law or infringes anyone's rights
- try to get unauthorised access to the site, our systems or other people's data
- introduce viruses or anything harmful, or overload the site
- copy the site, or scrape it or the demo, at scale or by automated means
We may suspend access to the site or the demo if we reasonably believe these terms are being broken.
6. Our intellectual property
The whitsun name and wordmark, the site's design, text, illustrations and software belong to us or our licensors. You may view the site and share links to it, but not reuse its content commercially without our permission.
7. Other websites
Links to other sites, such as the booking page run by HubSpot, are provided for convenience. We aren't responsible for their content or how they handle your data.
8. Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited under English law. If you're using the site as a consumer, your statutory rights aren't affected.
Subject to that, the site, the demo call and the consultation are provided free and as they are. We aren't liable for any loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss, arising from your use of them. Our total liability to you in connection with them is limited to £100.
9. Changes, law and contact
We may update these terms; the date at the top shows when they last changed. The version on the site when you use it applies.
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live in Scotland or Northern Ireland and use the site as a consumer, you may also bring proceedings there.
